We successfully represented Scanad Kenya Limited, a subsidiary of WPP Scangroup PLC, a global advertising giant in a USD 2.5 M contractual dispute with Kenya’s election body, the Independent Electoral Boundaries Commission. The matter involved the Elections Body refusal to pay circa USD 2.5 M to Scanad despite Scanad discharging their contractual obligations. Notably, the Elections Body denied that Scanad had discharged their contractual obligations.
This matter touched on whether summary judgment (without full trial) could be entered against a government related entity. Though, this question was not raised by IEBC in the litigation it was implicitly answered by the decision of the Court which has not been challenged and the time period for doing so has since lapsed.
