LJA successfully represented Guardian Bank Limited in the Supreme Court against Bookpoint Limited.
The Supreme Court agreed with LJA that the filing of a Notice of Appeal within the timelines specified in the Supreme Court Rules is a jurisdictional prerequisite.
In dismissing an application to file a Petition to the Supreme Court out of time, the Court agreed with LJA and reiterated that the only rules applicable to proceedings before the Supreme Court are the Supreme Court Rules and therefore a failure to file a notice of appeal within the timelines set by the Rules meant that there was no notice of appeal upon which a further application to file the Petition out of time could be pegged.
